A Hamilton tenant has been allowed by the Tenancy Tribunal to stay on in her rental property despite numerous anti-social breaches of the RTA. The landlord followed what he/she though was correct procedure by issuing the tenant with notices about anti-social behaviour on 3 separate occasions and then applying to the Tribunal for termination within 28 days of the last notice. The landlord’s application failed however because the tenant was on a fixed term tenancy not a periodic. Had the tenant been on a periodic tenancy the Tribunal said that it would not have been unfair to end the tenancy. Fixed term tenancies aren’t covered by the section of the RTA which allow tenancies to be cut short or ended due to tenant anti-social behaviour.
