Joint tenancies


Q: Two tenants are named on a tenancy agreement as being joint tenants, but one moves out and stops paying rent because he/she is no longer living at the property. Does the remaining tenant become responsible for paying all the rent?

A: The simple answer to this (often encountered problem), is that as a landlord it makes no difference to you who pays the rent, or how much each tenant in a joint tenancy contributes towards the weekly rent, so long as the amount paid is the correct amount. If the remaining tenant doesn’t pay all of the rent required, then any action taken needs to be taken against both of the tenants as they are both jointly responsible.
