Yes, the Tribunal can terminate tenancies for rent arrears at present. However, the tenants need to be in arrears of 60 or more days (it used to be 21 days). Recent Tribunal rulings seem to indicate that adjudicators are ruling in favour of landlords where the tenants are in rent arrears exceeding 60 days. That is good news for landlords as one of the criteria the Tenancy Tribunal has to consider in such cases is whether the tenant is making a ‘reasonable’ effort to pay rent.
